Agree When Property Agency Commission Is Payable

When discussing agency commission, agree both the amount and the event that makes it payable. “Completion” can mean different things to different people.

For Owners

On this page

Define the trigger

Identify the service, payer, calculation basis and payment date. Explain whether the relevant event is an introduction, a resulting contract or another specified service. “Pay after success” is incomplete without defining success. Applicable law and the actual arrangement matter. Do not assume that commission can only arise after title registration.

Address changes in the transaction

Discuss failed bank finance, withdrawal by either party and a tenant not moving in. For a conditional transaction, explain the treatment if the condition is not met. Separate commission from advertising and third-party expenditure, including any prior approval. A percentage alone does not describe every possible charge.

Reconcile the final payment

Check the amount, trigger and recipient against the signed arrangement and obtain appropriate evidence. If agents cooperate, clarify who charges the client. Where a dispute already exists, review the actual contract and events rather than treating a general guide as a decision that payment is always due or always avoidable.
