Authorise an Agent to Receive a Property Payment

If an agent needs to receive a particular transaction payment, authorise that payment expressly. A sale or letting appointment should not simply be used as collection authority.

Identify the payment

State the property, payer, purpose, amount or calculation and expiry of authority. A mandate for one reservation payment need not cover the balance or changes to refund terms. First consider whether direct payment to the authorised contracting party would be simpler.

Agree receipt and onward payment

Specify the account, transfer deadline, receipt issuer and how the payer and owner receive confirmation. The personal or company account must match the agreed authority; verify changes afresh. Collection by an agent is not automatically escrow or a bank guarantee and should not be described that way.

Define what happens when authority ends

Address expiry, withdrawal and cancellation, including payments not yet received, money held and any refund. The person deciding a refund and the person paying it should be consistent with the transaction terms. Give relevant parties enough authority information before payment, then reconcile the amount and destination. A casual message to “pay the agent” is insufficient for an unclear arrangement.

If signing authority is also needed, read Authorise an Agent to Sign a Specific Property Document.
