Verify Who Must Pay a Guaranteed Rental Return

For a new condo advertised with guaranteed rent, identify the company that must pay. The developer, sales company and operator may have different roles even when they use the same project brand.

Find the payment obligation

Check whether a separate lease or operating agreement accompanies the sale. Identify the full company name, registration reference, payment schedule and authorised signatory. A marketing promise should connect to an identifiable obligation.

Check the relationship

Use appropriate company records and ask how the payer relates to the developer, building management and property. If a separate guarantee is claimed, examine the guarantor, scope and conditions. A group brand or the word “protected” is not itself a legal guarantee. Registration alone does not establish the ability to make future payments.

Confirm the operating contact

Establish who issues statements, handles reconciliation and responds to missed payments. Match payment accounts to the agreement and document any third-party arrangement. If the payer cannot be identified, do not budget for the advertised return as certain income. Examine deductions and exit terms separately.

After identifying the payer, read Calculate a Guaranteed Rental Offer After Deductions.
